The Lyrics

Samuel Alito, who earned the American Bar Association's highest rating, will probably be approved by the Senate to replace Justice Sandra Day O'Connor in the near future, but some Democrats are considering a filibuster. One of the reasons that Senator Dick Durbin gives for opposing the nomination is that Judge Alito gave a cautious answer to a question about whether he is a Bruce Springsteen fan.

These are the times that try men's souls. In the course of our nation's history, the Senate Judiciary Committee has always gridlocked whenever difficult decisions have needed to be made. Today, a new crisis has arisen. Supreme Court Associate Justice Sandra O'Connor, also known as Sandra Day, is attempting to resign to provide care for her sick husband, but the Judiciary Committee will not vote on her successor. Citizens, hear me out. These senators get elected by you!

(Eight bar guitar, banjo introduction)

Well, let me tell you the story of a judge named Sammy
And his powerful resume.
He got Bush's nomination, and he left Philadelphia
To take over for Sandra Day.

But, was he ever confirmed?
No, he's not yet confirmed,
And his fate is still unlearned.
He may wait forever for the vote of Durbin
He's the judge who can't get confirmed.

Sammy answered all the questions, but he hedged on Springsteen,
Which made Dick Durbin really cross.
So he got indignant and he threatened filibuster
Just to show Alito who's Boss!

But, did he ask about Bruce?
Yes, he asked about Bruce,
And his reason's most obtuse.
They explore strange topics in judicial hearings,
Maybe next, they'll try Dr. Seuss.

Now all day long Sandra curses the Senate
Crying, "What will become of me?
When can I go care for my husband in Phoenix
And swing my vote out of DC?"

But, was she ever replaced?
No, she's still not replaced,
And she thinks it's such a waste:
Senators delay on judicial appointments,
But they pass their pay hikes in haste!

Kennedy and Spector are acting bombastic
Every day from morning "til noon.
And through the C-SPAN cam'ra, we see Justice O'Connor
Begging them to wrap it up soon.

But do they ever behave?
No, they never behave
"Cause attention's what they crave.
But they'll rule forever on Judiciary,
These old men who never behave.

Now all you viewers of C-SPAN viewers, don't you think it's a scandal,
How these Senators just talk and talk.
Vote these incumbents out, and you might say goodbye
To lame speeches and to gridlock.

Will Sammy then get confirmed?
Will he then get confirmed?
And will Sandra get adjourned?
Will the Senate move forward with judge appointments
If these members all get out-termed?

Pretty good, and I didn't take off any points for misspelling Arlen Specter. It's good to see "MTA" redone well. But will one of you right-of-center people explain to me what was so bad about the way the Democrats, especially my boys Ted Kennedy and Joe Biden, questioned Sam the Sham? From what I saw, the problem wasn't with the questions but with the answers. Sam Alito is highly qualified, highly intelligent, and by all accounts a decent man. He's even a fellow New Jerseyan and a good baseball fan. Make him Commissioner. Boot out Bud the Dud Selig. Alito is certainly anti-labor enough to make the team owners happy. But anyone with Alito's disdain for the right of privacy -- and ALL that it entails, including the right to choose if and when to have a child -- disqualifies him from the Supreme Court if I have a vote. Of course, I don't, which is why I'm trusting the Democrats to do the right thing and talk this nomination to the death it deserves.

I don't see anybody having the filibuster balls on this one. Except maybe Barb Boxer and Dianne Feinstein. Great song, anyway!

Thanks for the comments.

Michael, I hate to have my spelling mistakes pointed out, but it shows that you probably read the whole thing. I think that the way Kennedy, Biden, and the rest of the Democrats questioned Alito was similar to the way Republicans questioned Ruth Bader Ginsburg and Stephen Breyer after they were nominated by Clinton. And Ginsburg and Breyer were just as noncommittal as Alito. I was poking fun at Kennedy and Specter primarily for their humorous exchange concerning Kennedy’s request to subpoena the records of the Concerned Alumni of Princeton. Kennedy kept repeating that he had requested the subpoena one month earlier and Specter kept denying it. Kennedy eventually showed a letter from Specter’s staff proving that he had done as he said, but the New York Times had obtained the documents one month earlier and found no references to Alito. So Kennedy was right, but he was making a big issue out of nothing.

Bob, Boxer and Feinstein are my senators, too, and last week, I e-mailed both of them requesting them to vote to confirm Alito. Of course, I have about as much chance of influencing their opinions as I do of influencing Michael Pacholek, and they both subsequently came out in opposition to Alito.

That's politics for ya. Sometimes I wonder what would happen if a bunch of old men on the Supreme Court died and the Senate refused to confirm anyone to take their place. Would the cases just pile up, or would the remaining judges take them, or what? And suppose things got so partisan that all the guys on the court died and weren't replaced? Then what? No ones this time...
